Legal Basis for Smart City Implementation

In order to ensure ease of governance in the planning, construction, operation and development of smart cities, it must refer to statutory regulations, national standards and guidelines set by agencies that have the relevant authority.

Some laws and regulations that can become the legal basis and reference for smart city implementation include:

  1. Law Number 23 of 2014 concerning Regional Government as amended several times, most recently by Law Number 9 of 2015 concerning the second amendment to Law Number 23 of 2014 concerning Regional Government;
  2. Law Number 26 of 2007 concerning Spatial Planning;
  3. Law Number 11 of 2008 concerning Information and Electronic Transactions
  4. Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions
  5. Law Number 14 of 2008 concerning Openness of Public Information;
  6. Law Number 25 of 2009 concerning Public Services
  7. Law Number 25 of 2004 concerning the National Development Planning System;
  8. Law Number 11 of 2020 concerning Job Creation
  9. Government Regulation Number 40 of 2006 concerning Procedures for Preparing National Development Plans;
  10. Government Regulation Number 18 of 2016 concerning Regional Apparatus.
  11. Presidential Regulation Number 95 of 2018 concerning Electronic-Based Government Systems
